Independent Review by the Healthcare Commission

Who can complain?

Everyone eligible to make a complaint under the NHS complaints procedure has the right to an independent review by the Healthcare Commission of their complaint if they are not satisfied at the end of local resolution.

The Healthcare Commission can consider a complaint which

(a) is made by a patient or any other person who is affected by, or likely to be affected by, the action or omission of the NHS foundation trust which forms the likely subject matter of the complaint; and
(b) is reasonably connected with the provision of health care or other services to patients by or for the NHS foundation trust.

How do they complain?

In the interests of promoting good access, the Healthcare Commission will accept a complaint verbally, electronically or in writing.

All complainants are encouraged to complete the standard form in requesting an independent review, which can be posted to them or they can download the form (external link) from the Healthcare Commission website

A request may also be made to the NHS body or the primary care provider which was the subject of the complaint. The regulations require that this request must be forwarded immediately to the Healthcare Commission
